Welcome to BECOMING.
These Terms of Service (“Terms”) govern your access to and use of the BECOMING website, content, features, and services.
BECOMING is operated under the Sparks to Becoming name. References in these Terms to “BECOMING,” “we,” “us,” or “our” refer to the operator of BECOMING and this website.
By accessing or using the website, you agree to these Terms. If you do not agree with these Terms, please do not use the website.
As BECOMING grows, we may introduce additional features, products, services, events, experiences, community opportunities, collaborations, and other ways to engage. These Terms apply to those offerings where appropriate unless separate or additional terms are provided.
BECOMING exists to invite people to notice their lives more deeply, reflect honestly on what they discover, and become more fully themselves.
The website shares meaningful moments, observations, questions, images, experiences, and perspectives as invitations to pause, notice, reflect, and discover what resonates within our own lives.
BECOMING does not prescribe a particular path, belief system, worldview, or outcome. Content is offered for reflection, exploration, connection, and general informational purposes.
Your experiences, interpretations, decisions, and choices remain your own.
You may use BECOMING only in accordance with these Terms and applicable law.
BECOMING is intended for a general audience. You may not knowingly provide personal information through BECOMING if you are under 16 without the involvement and permission of a parent or legal guardian where required.
You agree not to use the website in a manner that:
• violates applicable law or the rights of another person;
• interferes with the operation, security, or integrity of the website;
• attempts to gain unauthorized access to systems, accounts, or information;
• introduces malicious software, harmful code, or disruptive technologies;
• impersonates another person or misrepresents your identity or affiliation;
• harvests or collects information about others without authorization; or
• uses BECOMING for unlawful, fraudulent, abusive, or harmful purposes.
Unless otherwise indicated, the content created for BECOMING, including original writing, reflections, photographs, images, graphics, designs, branding, logos, butterfly marks, visual treatments, website design elements, collections, and other original materials, is owned by or licensed to BECOMING and is protected by applicable intellectual-property laws.
You are welcome to view, read, and engage with BECOMING content for your personal, noncommercial use.
Unless BECOMING expressly gives permission, you may not reproduce, republish, distribute, sell, license, modify, commercially exploit, or present BECOMING content as your own.
Sharing a link to publicly available BECOMING content through ordinary social or digital sharing features is permitted, provided the content is not materially altered or falsely attributed.
Nothing in these Terms transfers ownership of BECOMING's intellectual property to you.
BECOMING may invite you to submit reflections, stories, observations, questions, experiences, images, perspectives, or other materials (“Submissions”).
You retain ownership of the original material you submit.
Submitting material to BECOMING does not, by itself, transfer ownership of that material to BECOMING.
When a submission feature gives you a choice regarding publication or sharing, the choice you make controls whether BECOMING may consider that Submission for public use.
If you select an option indicating that you are sharing something privately and do not give BECOMING permission to publish or share it, your Submission is treated as a communication to BECOMING rather than material authorized for public publication.
BECOMING will not intentionally publish that Submission as BECOMING content without obtaining additional permission from you.
If you expressly give BECOMING permission to consider your Submission for publication or sharing, you grant BECOMING a non-exclusive, worldwide, royalty-free license to use, reproduce, display, publish, distribute, and share the Submission for BECOMING-related editorial and promotional purposes.
This license does not transfer ownership of your Submission to BECOMING.
Because the license is non-exclusive, you remain free to use your own original material elsewhere.
Giving permission to consider a Submission does not guarantee that BECOMING will select, publish, or otherwise use it.
When BECOMING provides attribution choices, we will use the preference associated with the Submission.
For example, you may be able to choose whether a published Submission is attributed using your first name or shared anonymously.
If circumstances require a different form of attribution, BECOMING may contact you before publication.
BECOMING may also choose to publish authorized material without identifying the contributor where doing so is consistent with the contributor's selected preference and applicable law.
If you authorize BECOMING to consider your Submission for publication or sharing, you also permit reasonable editorial changes necessary for presentation.
These may include changes to grammar, spelling, punctuation, length, formatting, organization, clarity, or presentation.
BECOMING will not intentionally make an editorial change that materially alters the meaning of your Submission without seeking additional permission.
BECOMING may also excerpt an authorized Submission when doing so preserves the substance and context of the material being shared.
You may contact BECOMING to request that permission for future use of a Submission be withdrawn or that previously published material be removed.
We will consider and respond to reasonable requests and, where appropriate, discontinue future uses within our control.
Withdrawal of permission does not necessarily require BECOMING to undo uses that occurred before the withdrawal request was received.
Material that has already been publicly shared may also remain in search-engine results, third-party websites, social-media shares, screenshots, archives, backups, printed materials, or other locations outside BECOMING's reasonable control.
You are responsible for the material you submit.
By submitting material to BECOMING, you represent that you have the right to provide it and, when you grant publication permission, the right to authorize BECOMING to use it as described in these Terms.
Please do not submit material that:
• infringes another person's copyright, trademark, privacy, publicity, or other rights;
• contains material you do not have permission to share;
• contains confidential information belonging to another person or organization;
• is knowingly false, fraudulent, deceptive, or impersonates another person;
• contains unlawful threats, harassment, exploitation, or abuse;
• promotes hatred, discrimination, dehumanization, or violence against people based on protected characteristics;
• contains malicious code, spam, or other harmful material; or
• otherwise violates applicable law.
BECOMING may decline, remove, or discontinue use of any Submission at its discretion, including material that is inconsistent with the purpose, values, safety, or integrity of BECOMING.
BECOMING is not required to review, respond to, publish, preserve, return, or otherwise use any Submission.
Permission to consider material for sharing is exactly that: permission for BECOMING to consider it.
Editorial selection remains within BECOMING's discretion.
BECOMING may introduce community, commenting, discussion, account, membership, contributor, collaboration, or other interactive features in the future.
If you choose to participate in those features, additional guidelines or terms may apply.
Participants will be expected to engage in ways consistent with the dignity, freedom, safety, and humanity of others.
BECOMING may moderate, restrict, suspend, or remove access to interactive features or content when reasonably necessary to protect participants, the community, the website, or BECOMING.
BECOMING may in the future offer products, merchandise, journals, events, tickets, experiences, memberships, professional resources, collaborations, digital materials, or other paid or unpaid offerings.
Specific offerings may be subject to additional terms concerning pricing, payment, shipping, returns, cancellations, participation, eligibility, availability, or other conditions.
If additional terms are presented for a particular offering, those terms will apply to that offering in addition to these Terms.
Prices, availability, descriptions, and offerings may change from time to time.
BECOMING may link to or integrate with websites, platforms, payment providers, social-media services, resources, collaborators, professionals, or other third parties.
Those services are operated independently from BECOMING.
BECOMING does not control and is not responsible for the content, availability, security, policies, practices, products, or services of third parties.
Your use of a third-party service may be governed by that third party's own terms and privacy policies.
BECOMING content is intended to encourage observation, reflection, curiosity, connection, and personal exploration.
Unless expressly stated otherwise for a particular service, BECOMING content is not professional medical, mental-health, psychological, legal, financial, therapeutic, or other individualized professional advice.
Nothing on the website creates a professional-client, therapist-client, attorney-client, financial-adviser-client, or similar professional relationship.
You remain responsible for determining whether and when professional guidance is appropriate for your circumstances.
We may modify, update, suspend, discontinue, or change any part of the website, its content, features, or services from time to time.
We do not guarantee that the website or any particular content or feature will always be available, uninterrupted, secure, or error-free.
We may correct errors, update content, and make changes without prior notice where appropriate.
To the extent permitted by applicable law, BECOMING and its website, content, features, and services are provided on an “as is” and “as available” basis.
We do not make warranties that the website will be uninterrupted, error-free, completely secure, or suitable for every person's particular circumstances or purposes.
Nothing in these Terms excludes warranties or rights that cannot legally be excluded.
To the extent permitted by applicable law, BECOMING and its owners, operators, affiliates, contributors, contractors, and service providers will not be liable for indirect, incidental, special, consequential, or punitive damages arising from or related to your use of, or inability to use, the website, content, or services.
Nothing in these Terms limits liability that cannot legally be limited or excluded.
To the extent permitted by applicable law, you agree to be responsible for claims, losses, liabilities, damages, and reasonable expenses arising from your material violation of these Terms, your unlawful use of BECOMING, or a Submission that infringes or violates another person's rights.
This provision does not require you to indemnify BECOMING for conduct for which indemnification cannot lawfully be required.
Your use of BECOMING is also subject to our Privacy Policy.
The Privacy Policy explains how personal information may be collected, used, shared, retained, and otherwise handled when you interact with BECOMING.
Where a BECOMING feature asks you to provide personal information or a Submission, both these Terms and the Privacy Policy may apply.
These Terms are governed by the laws of the Commonwealth of Massachusetts, without regard to conflict-of-law principles, except where applicable law requires otherwise.
Any dispute concerning these Terms or BECOMING will be handled in accordance with applicable law and any additional dispute-resolution terms that may apply to a particular service or offering.
BECOMING will continue to evolve.
We may update these Terms from time to time to reflect changes in the website, services, offerings, business practices, or legal requirements.
When we make changes, we will update the Last Updated date at the top of these Terms.
Your continued use of BECOMING after revised Terms become effective constitutes acceptance of the revised Terms to the extent permitted by applicable law.
Material changes may receive additional notice when appropriate or required by law.
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue in effect to the extent permitted by law.
These Terms, together with the Privacy Policy and any additional terms applicable to a particular BECOMING feature, product, service, event, or experience, constitute the agreement governing your use of the applicable BECOMING offerings.
